Terms of Sale (Distance Sales Agreement)

These Terms of Sale (Distance Sales Agreement, the "Agreement") are concluded between the SELLER and the BUYER identified below when the BUYER places an order electronically on www.gaonbridal.com, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

BUYER
The natural or legal person who places an order on www.gaonbridal.com and provides their name, address, contact and billing details during checkout. The BUYER's details appear in the order summary and the order confirmation email.
2. SUBJECT
This Agreement sets out the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered by the BUYER, whose characteristics and price are shown in the order summary.
3. PRODUCT, PRICE AND PAYMENT
3.1. The main characteristics of the product, quantity, size/measurement details, the total price including taxes, any shipping fee, the payment method and delivery details are shown in the order summary and the order confirmation email and form an integral part of this Agreement.
3.2. All GAON Bridal pieces are made to order and produced individually for each customer (pre-order); no stock is held. The BUYER places the order with this knowledge.
3.3. For deliveries within Türkiye, prices include Turkish VAT. For deliveries outside Türkiye, the price shown in the selected currency (USD / EUR) is the final product price; as an export sale, no Turkish VAT is added.
3.4. Payment is made by bank transfer or by secure one-time card payment via iyzico. Card details are never seen or stored by the SELLER.
3.5. If a price is displayed incorrectly due to an obvious error (e.g. a system or typing error), the SELLER may cancel the order after informing the BUYER; any amount paid will be refunded in full.
4. DELIVERY
4.1. Production starts once payment is confirmed. Delivery times:
- Within Türkiye: minimum 40 days,
- International orders: 40–60 days.
These times result from the made-to-order nature of the products and are communicated before the order on the product page, at checkout and in this Agreement. If the SELLER fails to deliver within the stated time, the BUYER may terminate the contract and any amount paid will be refunded within 14 days.
4.2. Shipping fee: Standard shipping within Türkiye is included in the price. International orders are shipped with DHL Express; the shipping fee for the destination country is shown separately and clearly at checkout and added to the order total.
4.3. Customs: For international shipments, any customs duties, import VAT and fees charged in the destination country are payable by the BUYER under that country's rules (DAP delivery). Customs procedures may affect delivery times.
4.4. The product is delivered to the address provided by the BUYER, to the BUYER or a person they designate. If the parcel shows visible damage, the BUYER is advised to have the courier record it. The SELLER is not responsible for delays caused by an incorrect or incomplete address.
4.5. Tracking details are sent by email once the order has been dispatched.
5. RIGHT OF WITHDRAWAL
5.1. As a general rule, consumers may withdraw from a distance contract within 14 days of delivery without giving reasons.
5.2. Exception: The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised (Turkish Distance Contracts Regulation Art. 15/1-(ç); EU Directive 2011/83/EU Art. 16(c); UK Consumer Contracts Regulations 2013, reg. 28). GAON Bridal pieces are produced to order according to the BUYER's size, measurements and choices; therefore the right of withdrawal does not apply and general returns are not accepted. The BUYER expressly confirms this at checkout.
6. DEFECTIVE PRODUCTS AND STATUTORY RIGHTS
6.1. The SELLER is responsible for delivering the product sound, complete and in accordance with the order.
6.2. If the delivered product shows a tear, faulty stitching, a wrong item, a significant production defect or serious shipping damage, we kindly ask you to notify us with photos within 3 days of delivery at iletisim@gaonbridal.com so that we can resolve it quickly.
6.3. Once the defect is confirmed, the product will be repaired or replaced free of charge, or another suitable solution will be agreed with the BUYER. This notice period does not limit your statutory rights. Consumers in Türkiye keep their rights under Art. 11 of Law No. 6502 (withdrawal from the contract, price reduction, free repair or replacement) within the 2-year statutory period. Consumers resident in the EU or the UK keep the statutory conformity guarantee under the law of their country of residence.
6.4. Incorrect measurements or size choices provided by the BUYER, differences in personal expectations, minor variations inherent in handmade work, and damage caused by use or improper cleaning are not defects.
7. CANCELLATION
As production starts after payment confirmation, the BUYER cannot cancel the order unilaterally. If the SELLER is unable to produce or supply the product, the BUYER will be informed without delay and any amount paid will be refunded within 14 days.
8. PERSONAL DATA
The BUYER's personal data is processed to perform the order, as described in our Privacy Policy.
9. GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of the Republic of Türkiye. Consumers in Türkiye may apply to the Consumer Arbitration Committee or the Consumer Court of their place of residence or of the transaction, within the monetary limits announced annually by the Ministry of Trade. Consumers resident outside Türkiye keep the protection of the mandatory consumer laws of their country of residence and may also bring proceedings in the courts of that country.
10. ENTRY INTO FORCE
Before placing the order, the BUYER confirms having read and accepted the Pre-Contractual Information Form and this Agreement. The Agreement enters into force when the order is confirmed. An order-specific copy is attached to the order confirmation email and kept by the SELLER for 3 years.
MODEL WITHDRAWAL FORM
Although made-to-order goods are excluded from the right of withdrawal, the model form is provided as required by law. Requests may be sent to iletisim@gaonbridal.com; the SELLER will review them and may offer an alternative solution.
